This website is operated and maintained by Chiropody Appliance Service Ltd (referred to in these terms and conditions as "we", "us", and "our"), a company registered in England and Wales (company number: 05155438), whose registered office is at 1 Cornhill, Ilminster, Somerset, TA19 0AD, UK.  Our trading address is Unit 5b, Colyton Business Park, Wheeler’s Yard, Colyton, Devon, EX24 6DT, UK.  Our VAT number is 821 7601 49.

These terms and conditions (together with any other terms and policies referred to in them) are the terms on which you may use www.4footpaint.co.uk (our “website”).  If you use this website you agree to be bound by these terms and conditions.  If you do not accept these terms and conditions, you must not use this website. 

1.         Access to the website

We will use reasonable endeavours to enable uninterrupted access to this website but access to this website may be suspended, restricted or terminated at any time.  We do not accept liability if the whole or any part of our site is unavailable or inaccessible at any time or for any period.  We reserve the right to change, modify, substitute or remove any information on this website and/or restrict access to this website or any part of it, without notice from time to time. 

2.         Buying from our website

If you order goods on our website, your order and our supply of those goods will be governed by the applicable terms and conditions herein.

3.         Privacy Policy

We collect, use and process personal data and other information in accordance with our Privacy Policy.  By using our website, you consent to such collection, use and processing.

4.         Registration

When you place your order on our website we will ask you to register by providing your name and full address details (and delivery address if different to your billing address), contact telephone number and e-mail address.  This information will be securely stored - it is only accessible to you via your username and password.  You should keep you username and password secure at all times as they will help you retrieve your details and make ordering quick and easy.    You must inform us immediately of any changes to the information that you provided when registering by updating your details.

5.         User name and password

When you register with us, you are given a user name and password which must be used in order to access certain parts of the website.  The user name and password are personal to you and are not transferable.

Your name and password are the methods used by us to identify you and so are very important.  You are responsible for all information posted on the website by anyone using your user name and password.  Any breach of security of a user name and password should be notified to us immediately.

6.         Ordering

You select the products you want to buy and place your order through our website.  By ordering products from our website you promise that:

a)     you are at least 18 years of age or have the permission of your parent or guardian to make a purchase.

b)    you undertake that all details you provide to us for the purpose of ordering or purchasing goods or services are correct.

c)     you are ordering products for your personal and domestic (private) use and not for resale or business.

d)    you are ordering products from (and for use in) the UK Mainland.

When you submit an order using our website we will follow the procedures detailed below:

a)     you will receive a confirmation email as an acknowledgement of your order within one hour.  This email does not constitute acceptance of your order by us. 

b)    acceptance of your order and the formation of the contract between you and us will take place when we dispatch the goods to you. 

c)     all orders are subject to acceptance and product availability. 

d)    if we are unable to fulfil your order any monies paid will be refunded to you as soon as possible and at the latest within 30 days. 

e)     our working days are Mondays to Fridays excluding public holidays.

7.         Prices

All prices on www.4footpain.co.uk (our “website”) are correct at the time the information is listed, however, we reserve the right to change the price of products at any time.  All our website prices include VAT at the current UK rate. 

Despite our best efforts it is always possible that some products may be incorrectly priced.  We reserve the right to correct at any time any obvious errors in price that could reasonably have been spotted as a mistake. 

8.         Payment

Payment must be made in full at the time of order through PayPal.  We do not accept payment by cash, cheque or any other method.  If we reject your order at a later stage we will give you a refund.

9.         Postage and packaging costs

Post and package costs are charged per order.  

Post and package costs are non refundable in the event of items being returned. 

10.       Delivery

We will deliver to the UK delivery address specified on your order.  We are unable to accept changes to the delivery address.  It is your responsibility to make sure that someone is available to receive delivery and sign for items that require signature on delivery.  We are not able to deliver to PO boxes, or to addresses that are outside the UK.

We aim to despatch all in-stock goods with 24 hours of receipt (Monday to Friday only, not including bank holidays).  Your order may be delayed if the item is not in stock.  Our typical delivery time is five (5) working days from date of order.  Delivery times are approximate.

11.       Title and Risk

You will become the owner of the products once you have paid for them in full and they have been delivered to you.  We will be responsible for the products before they are delivered, but once they have been delivered they are at your risk.  This means that you are responsible for taking good care of them and for ensuring that they are not lost, stolen or damaged.

12.       Changing your order

If you want to change your order after it has been placed, you should Contact Us.  We cannot guarantee that we will be able to make any requested change, and do not have any obligation to do so.  This does not affect your right to cancel your order under Condition 11.1 if you change your mind.

13.       Cancelling your order

You may cancel your order at any time prior to your order being processed by email to sales@4footpain.co.uk or by post or by telephoning 01297 553818 during normal office hours (Monday to Friday excluding public holidays).

You may also withdraw from the contract at any time after the product has been dispatched by advising us in writing or by email to sales@4footpain.co.uk and returning the goods to us in perfect condition with their original packaging intact within 7 days after the day on which you received your goods.  You will be refunded the full price of the goods as soon as possible and within a maximum of 30 days after we receive the returned goods.

Once we receive notification from you that you wish to withdraw from the contract (in accordance with these terms) any sum debited to us from PayPal in relation to your order will be re-credited to PayPal as soon as possible and in any event within 30 days of your order provided that the goods you wish to return are received by us in the condition that they were in when delivered to you.

Please note we do not accept return of products that have been used or taken out of sealed packaging excepting for any products that are damaged or defective.

14.       Miscellaneous

We recommend you seek advice from a podiatrist, chiropodist, your GP or other appropriate health care professional if you are in any doubt about your medical condition or the suitability of any products we sell or any other information within this website.

Parts of our website may contain links to third-party websites for your convenience and information.  We assume no responsibility for the content of any other websites to which this website has links from time to time and we make no representation or warranty about any such website or its content.  See our Privacy Policy for further information concerning links.      

16.       Liability

If you use this website for any illegal purpose or for any purpose in breach of (not complying with) these terms and conditions, you will be liable to indemnify us in full for any loss, liability or costs which we incur arising from or in connection with such use or alleged use.

Our website and its content are provided on an 'as is' basis and without liability on our part for any direct, indirect, special, consequential, or other loss, damage, cost or expense that may be suffered in connection with its use or as a result of any reliance being placed upon it. 

We do not exclude our liability for death or personal injury caused by our negligence, for fraudulent misrepresentation or for any other liability that may not lawfully be excluded (and these terms and conditions are to be interpreted accordingly).

We will only be liable for direct loss up to a maximum total of the price of the product or service purchased in respect of any claim.

We shall use reasonable endeavours to ensure that the information and any data contained within this website are accurate and to correct any errors or omissions as soon as practicable after being notified of them.  To the extent permitted by applicable law, we disclaim all warranties and representations (whether express or implied) as to the accuracy of any information contained within this website.  We do not accept liability for any errors and omissions and reserve the right to change information, specifications and descriptions of listed goods, products and services.  We do not guarantee that this website will be fault free and do not accept liability for any errors or omissions.  We do not give any warranty that this website is free from viruses or anything else which may have a harmful effect on any technology.

As the products on our website are directed at consumer customers, we do not accept liability for business losses (such as loss of profits, business, anticipated savings or goodwill) or losses suffered by anyone other than you.

We will not be liable for any failure or delay in the performance of our obligations caused by events outside our reasonable control, such as natural disasters, fire, flood, disease, war, terrorism, strikes, emergency laws or problems with power supplies, the internet, telecommunications or transport systems.

You agree to use this website and the data contained within it appropriately and only for the purposes stated on the website and in accordance with these terms and conditions.  You must not attempt to gain unauthorised access to our website, the server on which our website is stored or any server, computer or database that is connected to our website.

Whilst we endeavour to ensure that our website is secure and free of viruses and other malicious or technologically harmful material, we cannot guarantee that it is.  We strongly advise you to protect your computer with regularly updated anti-virus and firewall software and to log-out completely when you finish using our website on a shared computer.  You must not knowingly introduce viruses to our website, or use our website or its content for any unlawful purpose.

We may at our sole discretion, terminate or suspend your access to all or part of the website and/or any of the services available with it at any time, with or without notice, for any reason, including, without limitation, breach (non-compliance) of these terms and conditions.  Without limiting the generality of the foregoing, any fraudulent, abusive, or otherwise illegal activity, or that may otherwise affect the enjoyment of the website by others may be grounds for termination of your access to all or part of the website at our sole discretion and you may be referred to appropriate law enforcement agencies.  All disclaimers, indemnities and exclusions in these terms and conditions shall survive termination of these terms and conditions between us for any reason.

These conditions do not affect your statutory rights as a consumer.

21.       Business customers

Our online website is for consumer customers buying products for private (non-business) use.  If you wish to purchase products for resale or other business use you should Contact Us to get a copy of our standard terms and conditions for business customers.

If any provision of these terms and conditions is held, by a court, to be unlawful, invalid or unenforceable, that provision shall be deemed severed and the validity and enforceability of the remaining provisions of these terms and conditions shall not be affected.

These terms and conditions contain the whole of the agreement between you and us concerning this website and any order you may place or purchase you make, and they replace all earlier agreements and understandings with you, except for any fraud or fraudulent representation by either of us.

We reserve the right to make changes to these terms and conditions at any time and without notice.  All purchases from the date that the amended terms are placed on our website onwards will be governed by those new terms.  We also reserve the right to assign (transfer) these terms and conditions and to assign or subcontract any or all of our rights and obligations under these terms and conditions.
